Terms of Use
Who we are
TakeSermon turns sermons you record into notes. In these terms, "we" means TakeSermon. If you have any question about these terms, email hello@takesermon.com.
Key points
- You must be 16 or over.
- Only record where you are allowed to. That is your responsibility.
- Your recordings and notes are yours. We use them only to provide the Services.
- Notes are written by AI and can be wrong. Check anything important.
- Our liability is limited as far as the law allows.
- You can delete your account at any time.
1. Definitions
- "We", "us": TakeSermon.
- "Services": the TakeSermon apps, website and related services.
- "Your Content": anything you record, add or create in the Services.
- "AI Output": anything the Services create using AI.
These terms are an agreement between you and us. When you continue past the sign-in screen, you agree to them and to our Privacy Policy, and you consent to the processing it describes.
2. Eligibility and your account
- You must be 16 or over, or the age of majority where you live if that is higher and the law requires it.
- One account per person.
- Keep your sign-in details secure. You are responsible for activity on your account. Tell us straight away if you think someone else is using it.
3. Using the Services
Your licence. We give you a personal, limited, non-transferable right to use the Services on devices you own or control, for your own non-commercial use, while you keep to these terms.
Recording laws. You are responsible for making sure you are allowed to record. This includes following applicable laws and any rules set by the organiser or speaker. Some places require everyone recorded to agree.
Usage limits. The Services have usage limits, such as a weekly recording limit, shown in the app. We may change them.
You must not:
- use the Services unlawfully or to infringe anyone's rights
- record people without the permission the law or the organiser requires
- misuse or interfere with the Services, including bypassing limits, scraping, reverse engineering, or accessing other members' data
- use the Services where sanctions laws prohibit it
Suspension. We may suspend or restrict your access if you break these terms, if your use puts the Services or others at risk, or if the law requires it. We will tell you why unless the law prevents it.
4. Changes to the Services
We improve the Services over time and may add, change or remove features. We will give reasonable notice before removing an important feature. If we ever introduce charges, we will tell you first, and you will not pay anything unless you choose to. We may stop providing the Services; if we do, we will give at least 30 days' notice where we can.
5. Ownership and licences
- Your Content is yours. Where the rights are yours to give, you let us store, process and transmit Your Content only to provide the Services to you. That permission ends when you delete it or your account.
- We do not sell Your Content, and we do not let our AI providers train their models on it.
- Anonymous information. We may use information that cannot identify you to run and improve the Services.
- Our property. The Services, their design and their software belong to us or our licensors. These terms give you no rights in them beyond the licence in section 3.
- Feedback. If you send ideas or feedback, we may use them freely, without owing you anything.
6. Privacy and security
We protect Your Content with reasonable technical and organisational measures and handle personal data as our Privacy Policy describes.
7. AI Output and your promises
AI Output can be wrong. AI Output is created automatically and can be inaccurate or incomplete, including Bible references. You are responsible for checking AI Output before you rely on it or share it.
You promise that:
- you have the right to record and use the material you record
- your use of the Services follows the law where you are, including recording laws
- the information you give us is accurate
8. Ending your account
You can end these terms at any time by deleting your account in the app. We may close your account if you seriously or repeatedly break these terms, telling you why unless the law prevents it. When your account ends, your right to use the Services ends and Your Content is deleted as the Privacy Policy describes. Terms that by their nature should continue will continue to apply.
9. Disclaimers
We provide the Services "as is" and "as available". We do not promise they will be uninterrupted, error-free, or that AI Output will be accurate or complete. This does not affect your legal rights as a consumer.
10. Limitation of liability
- We are not liable for loss that was not foreseeable, for loss of business or profits, or for loss caused by AI Output that you relied on without checking.
- Our total liability to you for all claims is limited to the greater of £50 or the amount you paid us in the 3 months before the claim.
- Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
11. Apple and Google
These terms are between you and us, not Apple or Google. Apple and Google have no duty to provide support for TakeSermon and are not responsible for it, its content, or any claim about it, including claims that it infringes someone's rights. If TakeSermon fails to meet a promise that applies to it, you may tell Apple, who may refund any purchase price; Apple has no other obligation. If you downloaded TakeSermon from the App Store, Apple and its subsidiaries may enforce these terms against you. You must also follow the app store's own terms.
12. General
- Changes to these terms. We may update these terms. For important changes we will tell you in the app or by email at least 30 days before they take effect, where we can. If you keep using the Services after that, the new terms apply; if you do not agree, you can delete your account.
- Notices. We send notices by email or in the app.
- Transfer. We may transfer these terms to a company that takes over the Services; your rights stay the same. You may not transfer them.
- Events beyond our control. We are not responsible for delays or failures caused by events outside our reasonable control.
- Severability and waiver. If a court finds part of these terms unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
- Whole agreement. These terms and the Privacy Policy are the whole agreement between you and us about the Services.
- Law and courts. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EU, you keep the protection of your local consumer law and can bring a claim in your local courts.
